General Terms and Conditions
Montée Austria GmbH and Montée Germany GmbH
(referred to hereafter as the “Contractor”)
For Corporate Events, Groups, Associations and Corporate Travel
The companies Montée Austria GmbH and Montée Germany GmbH are hereinafter jointly referred to as the Contractor.
The client or customer is hereinafter referred to as the Client.
Booking
Only booking conditions agreed in writing shall apply.
We require a 70% advance payment of the total amount upon written confirmation of the order. A deposit invoice will be issued separately. The remaining balance (final invoice) is due two weeks after the invoice date. Any additional services incurred will be listed on the final invoice.
Your booking becomes legally binding and the execution of the event guaranteed only after receipt of the advance payment.
Travel documents
The event/travel confirmation, invoice, and travel information will be sent after booking by e-mail and/or post..
Value Added Tax:
All stated prices are net prices. Statutory taxes (in particular VAT) will be added, unless otherwise specified in the offer — for example, under the EU-wide Reverse Charge net price regulation for event services, provided the relevant tax requirements and reciprocal VAT ID numbers are met.
Cancellation by the customer, rebooking for individual event programs and incentive trips
Clients may withdraw from the contract at any time before the start of the event or trip.
Withdrawal must be made in writing via e-mail or post; the date of receipt of the written notice of withdrawal by Montée shall be decisive.
Cancellation Fees for Full Cancellations

Up to 6 months before start: 10% of the total price

From 6 months before start: 25% of the total price

Cancellation Fees for Full Cancellations

Up to 10% reduction in the planned number of participants: generally no cancellation fees up to 1 month before the event, unless otherwise stated by external service providers.

Up to 50% reduction: individual case review by Montée; a goodwill solution may be offered, subject to written confirmation.
Special Cancellation Conditions of External Service Providers
If services from hotels, artists, or other external partners have already been booked, their specific cancellation conditions apply.
We will adapt accordingly and provide these terms upon request.
Rebooking incentive trips and corporate events
For rebookings, we charge an appropriate fee based on the work, costs, and expenses incurred.
This rebooking fee depends on the rebooking date but is generally significantly lower than the cancellation fee rates.
If reorganization or restructuring of an event becomes necessary due to weather conditions, additional client requests, or changes in venue, these additional costs will be charged by agreement or based on actual time spent, at €80 per hour plus VAT and expenses.
If the planned event cannot take place due to weather or safety reasons, we will endeavor to offer an appropriate substitute program, communicate this in time, and carry it out.
If the client does not accept such a substitute program, the client and the organizer share the costs equally (50/50) in the event of cancellation due to extreme weather or safety situations (e.g. storms, thunderstorms, hail, flooding).
Liability regulations
Our contractual liability as event and travel organizer is limited to the total event or travel price.
If the performance of contractual obligations becomes significantly impeded or impossible due to force majeure, this constitutes valid grounds for termination by the Contractor.
In such cases, the agency may claim reasonable compensation for services already rendered and expenses incurred.
The Client expressly acknowledges that, in the event parts of the event cannot be carried out due to force majeure (especially adverse weather), an alternative program may be implemented.
The Contractor reserves the right to decide whether certain event elements can be carried out safely or must be replaced.
The Contractor is liable without limitation only for intent and gross negligence.
For slight negligence, liability applies only where a duty essential to the fulfillment of the contract’s purpose has been breached.
Insurance
The Contractor (Montée) holds a comprehensive business liability insurance covering all event and travel activities, including motorized vehicles exceeding 25 km/h.
The coverage amount per incident is €5,000,000 (five million euros) for personal and property damage, and €300,000 (three hundred thousand euros) for financial losses.
We additionally recommend taking out event/travel cancellation insurance and short-term accident insurance.
Please note that such insurance policies may have short application deadlines, which the Client is responsible for observing.
For travel abroad, we also recommend a comprehensive travel protection package (travel accident, health, liability, and luggage insurance).
Relevant insurance forms are available from Montée or any travel agency.
Copyrights and exploitation rights
All copyrights and exploitation rights to concepts, texts, photos, videos, and other products or services created by us remain the property of the Contractor.
By paying the agreed fee, the Client receives only the usage rights defined in the written order for the duration of the agreed contractual purpose.
Any extension of these rights, including use of products or concepts in other media or repeated events, requires a new written agreement.
The Client is not entitled to use materials (photos, videos, etc.) produced by Montée for external advertising purposes without explicit written permission.
Upon request, we may produce and provide photo and/or video material from events.
With written consent from the Client and involved individuals, Montée may use such material for marketing and promotional purposes.
The Client may use the provided material for internal purposes only unless otherwise agreed in writing.
Applicable Law and Jurisdiction
These General Terms and Conditions are governed exclusively by the laws of the Republic of Austria, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If the Client is a consumer as defined by the Austrian Consumer Protection Act (KSchG), the provisions of §6 para. 1 KSchG apply without limitation.
Invalid provisions shall only be void to the extent of their invalid part; all other clauses remain in full effect.
For bookings with Montée Austria GmbH, Austrian law applies.
For bookings with Montée Germany GmbH, German law applies.
The place of jurisdiction is the competent court for the federal state of Salzburg.
Final clause:
All personal data provided by the Client to the Contractor are processed and stored electronically but are protected against misuse.
Should any provision of these Terms and Conditions become invalid, this shall not affect the validity of the remaining provisions.
A substitute provision shall be agreed that most closely reflects the economic intent of the parties.
